Terms of Service

1. Scope

These Terms of Service govern the use of Chess Analytics (the website at chess-analytics.app and the web application, together the "Service"), operated by Henry Rausch (details in the imprint; "we", "us"). By creating an account you agree to these terms. Conflicting terms of users do not apply.

2. The Service

Chess Analytics shows statistics about your chess games from chess.com and Lichess. The Free plan includes game history, results, rating trends, openings and endings, based on the data those sites provide. ThePremium plan adds Stockfish analysis of every move, trend reports, scheduled reports and AI features. Premium is not yet available for purchase; paid plans will be offered under additional terms shown before purchase.

We continuously develop the Service and may change, add or remove features, as long as this is reasonable for you. There is no entitlement to a particular feature of the free plan.

3. Account

• You must be at least 16 years old, or have the consent of a parent or guardian, to create an account.
• Provide accurate information and keep your password confidential. You are responsible for activity under your account.
• Each person may hold one account. Accounts are personal and may not be transferred.
• Tell us immediately at [email protected] if you suspect misuse of your account.

4. Acceptable use

You must not:

• access the Service with bots, scrapers or other automated means, except through features we provide;
• overload, probe or circumvent the Service's security, rate limits or plan restrictions;
• upload content that infringes the rights of others or is unlawful;
• use the Service to violate the terms of chess.com, Lichess or other third parties;
• resell or make the Service available to others without our written permission.

5. Third-party services

Game data comes from the public interfaces of chess.com and Lichess, which we do not control. If they change, restrict or stop their interfaces, parts of the Service may stop working. Linking an account does not give us access to your password on those sites.

6. Analysis and AI content

Engine evaluations, statistics and AI-generated texts are produced automatically. They are meant for training and may be incomplete or wrong; AI texts in particular can contain errors. Do not rely on them where accuracy matters, and do not use the Service to get assistance during games you are playing.

7. Your content

You keep all rights to the games and other content you provide. You grant us a non-exclusive, free right to store and process this content to the extent needed to provide the Service to you. This right ends when you delete the content or your account, except where analysis results are shared with other users who analysed the same public game.

8. Availability

We aim to keep the Service available but do not guarantee uninterrupted availability. Maintenance, updates, security measures and events outside our control can cause interruptions.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.

For slight negligence we are liable only for breaches of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), and limited to the damage typically foreseeable at the time the contract was concluded. For the free plan, which is provided without charge, we are liable only for intent and gross negligence, except for injury to life, body or health.

These limitations also apply in favour of our representatives and agents.

10. Term and termination

The contract runs for an indefinite period. You can end it at any time by deleting your account in Settings, or by asking us at [email protected]. We can terminate a free account with two weeks' notice by email. Either party may terminate without notice for good cause, in particular for serious or repeated breaches of section 4. When an account ends, its data is deleted as described in theprivacy policy.

11. Changes to these terms

We may change these terms for valid reasons, for example legal changes or new features. We will tell you about changes by email or in the app at least four weeks before they take effect. Changes that materially affect your rights only apply if you agree to them; if you do not agree, we may terminate a free account in accordance with section 10.

12. Data protection

How we process personal data is described in our privacy policy.

13. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the country in which you have your habitual residence. If you are a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Magdeburg, Germany.

If a provision of these terms is invalid, the remaining provisions stay effective. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
